个人数据信托制度构建研究

摘要： 随着数字时代的到来，个人数据价值越来越高，个人数据安全问题愈发紧迫。当前，个人数据保护存在隐私政策或用户协议的合同困境、数据交易市场主体地位不平等以及数据权属不明等问题。为了破解交易市场中个人数据保护的困境，引入信托制度具有可行性和独特优势。通过引入第三方信托机构，明确数据权属、个人数据信托制度的基本构成以及相关配套制度，构建个人数据信托制度体系，推动数据权属的法律界定，以达到破解交易困境和保护个人数据权利的双重目的。

Research on the construction of personal data trust system

Abstract： In the digital age, the value of personal data is increasing, and the security issue is becoming more and more urgent. In the trading market, there are some problems in the protection of personal data, such as the contractual dilemma of privacy policy or user agreement, the unequal status of the main body in the data trading market and the unclear ownership of data. In order to solve the dilemma of personal data protection in the trading market, the introduction of trust system and third-party trust institutions has the feasibility and unique advantages to achieve the purpose of protecting personal data rights. By clarifying the data ownership, the basic composition of the personal data trust system and related supporting systems, the personal data trust system system is constructed.It is conducive to solving data trading dilemma and promoting the legal definition of data ownership.

引言
党的二十届三中全会明确指出，提升数据安全治理监管能力。目前，我国已经陆续出台了《民法典》《数据安全法》《个人信息保护法》《生成式人工智能服务管理暂行办法》等法律法规，但因整体表述过于原则,在个人数据保护方面作用有限。因此，有学者将信托制度引入个人数据保护领域，进而建立个人数据信托制度。2021年，数据信托（Data Trust）被《麻省理工科技评论》列为全球突破性技术。此后，国内学者研究数据信托制度达到高潮。例如，翟志勇较早提出数据信托作为一种数据治理的新方案［1］；李智提出数据信托本土化的困境与实现路径，法律通过设立信托机构的准入和监管机制来保障第三方机构信任程度［2］；魏远山提出个人数据信托的类型抉择问题，认为建立独立信托机构作为个人数据信托制度的关键［3］。国内相关成果注重研究制度的部分内容，未从整体制度构建层面进行系统性把握。本文试图明确个人数据信托的概念、优势等内容，探索构建个人数据信托制度体系，为我国个人数据信托立法提供理论参考。
