The legal structure of public data trusts: feature recognition, experiences for reference and China′s enlightenments

Abstract: Public data trust has a folded legal structure that balances data security and value distribution, and is a collaborative innovation engine that empowers the digital economy to integrate law, technology, policy, and capital. The experience of the UK′s "third-party data trust" model in terms of data trust subject matter, equitable legal trust relationships, and rights remedies is of great reference for China′s exploration of public data trusts and public data authorization operations. Based on this, measures are proposed to define the scope of public data trust objects, rigorously design the rights and obligations relationships between trust subjects, enhance the governance efficiency of public data trusts, and improve the regulatory mechanism of public data trusts, in order to promote the localization construction of public data trusts in China and provide useful reference for local governments to carry out public data authorization operations more efficiently and orderly.
